NAIL THERAPY ACADEMY TERMS OF USE

Welcome to Nail Therapy Academy (ABN 30 285 612 758). These Terms of Use govern your use of our website
located at nailtherapyacademy.com (Website) and any goods or services provided through the Website,
including digital nail art tutorial content and digital nail art educational course materials (Our Products).
By accessing or using the Website or purchasing Our Products you agree to be bound by these Terms of Use. If you do not agree with these Terms of Use, please do not use the Website or purchase Our Products.


1. Eligibility
You must be at least 18 years old or have parent/guardian consent to use this Website and purchase Our Products. By using the Website or purchasing Our Products, you warrant that you meet these eligibility requirements.


2. Our Products
Our Products include:

  • Downloadable nail art tutorials with guided voice/video instructions.
  • Online nail courses, including learning modules and Certificates of Completion upon successful completion.                                                                                    
  • Guided E-Books 

Certificates are for completion only, and do not constitute accreditation or a government-
recognised qualification unless expressly stated otherwise by us.
Our Intellectual Property


All Website content (including tutorials, course materials, videos, audio, text, logos, and trade marks) and Our Products (Our IP) are the property of Nail Therapy Academy and protected under Australian laws.

Any unauthorised reproduction, distribution, or public display of Our IP is strictly prohibited and may result in legal action.


3. Your Licence
Upon completing a purchase of Our Products, we will grant you a non-exclusive, non-sublicensable, non-
transferable and revocable licence to access and use your purchased Products for your personal educational use only (Licence).


All rights, title, and interest in Our Products remains with Nail Therapy Academy. Nothing in these Terms of
Use transfers any ownership rights to you.

4. Restrictions
You are strictly prohibited from:

  • Distributing, sharing, reselling, sublicensing or publicly posting Our Products or Our IP (such as via file-sharing platforms);
  • Modifing, reproducing or creating derivative works of Our Products or Our IP (such as educational materials for another business);
  •  Using Our Products or Our IP in any commercial or training context;
  • Circumventing any technological protection measures applied to Our Products or Our IP;
  • Using Our Products in any other way that contravenes the Licence.

We reserve the right to revoke the Licence with immediate effect if you breach these restrictions or these Terms of Use in any other way. You agree to promptly delete all copies of Our Products in your possession or control
upon revocation of the Licence by us.


5. Purchases and Payments
Prices are displayed in AUD and include GST where applicable. Payments are securely processed via
Shopify’s payment gateways.
Once a digital product is purchased, a download link will be sent to your email. For all digital downloads
and courses, all sales are final, and no refunds will be issued except where required by Australian
Consumer Law.
If you experience a technical issue, contact us within 7 days of purchase. We will use reasonable
commercial endeavours to resolve the technical issue. Our refund policy is subject to your rights under
the Australian Consumer Law.

6. Certificate of Completion
Upon successfully completing all required course components, a Certificate of Completion will be
automatically issued to your email or available to download.
Certificates are issued for personal achievement and do not imply professional accreditation unless
otherwise explicitly stated.
You must not alter, forge, or misrepresent your certificate or course completion status.
The Certificate of Completion provided by Nail Therapy Academy upon finishing one of our online nail courses:

  • Acknowledges your successful participation in a non-accredited educational program.
  • Does not constitute a government-accredited qualification or vocational license.
  • Should be used as proof of personal or professional development and skill- building only


Australia: Within Australia, there are currently no government certification requirements or licensing
regulations that mandate individuals to hold a formal qualification in order to legally perform nail services.
The only government-recognised qualification that includes nail services is the Certificate III or IV in Beauty Therapy, which is offered exclusively by accredited Registered Training Organisations (RTOs) such as TAFE or private beauty colleges. This qualification, however, is not legally required to operate as a nail technician or
provide nail services.
International: If you are located outside of Australia, it is your responsibility to check with your local licensing
authority, health department, or governing body to ensure you are compliant with any applicable laws or industry regulations.


7. Privacy Policy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect and use your data in compliance with the Privacy Act 1988 (Cth).

8. Disclaimers

All tutorials are for educational purposes only. We do not guarantee specific results from following our tutorials. Use of products or techniques is at your own risk. Always follow health and safety protocols in your work including correct curing times and quality gel products.
Nail Therapy Academy makes no representations or warranties of any kind, express or implied, as to the operation of the Website or the information, content, materials, or products included on the Website, except as otherwise provided under applicable laws.

9. Limitation of Liability

To the extent permitted by law, Nail Therapy Academy will not be liable for any indirect, incidental, or consequential loss arising from your use of our goods, services, Content or Website.

To the maximum extent permitted by law, Nail Therapy Academy's liability for any breach of these Terms, or for any defect in, or failure of, the products or services provided, is limited to (at our option):

(a) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment
of the cost of having the goods repaired; and
(b) in the case of services, the supplying of the services again, or the payment of the cost of having the
services supplied again.
Notwithstanding the above, Nail Therapy Academy will not be liable for any indirect, incidental, special, or consequential loss or damage, including loss of profits, data, or goodwill, arising from your use of our tutorials,
Content or this Website, unless such liability cannot be excluded by law.

10. Amendments

We reserve the right to update these Terms at any time. Changes will be effective upon posting to the platform.
Continued use of the site indicates your acceptance. It is your responsibility to review these Terms periodically for changes.

11. Governing Law

Any disputes arising under or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts of Victoria, Australia (and, where applicable, the Federal Court of Australia
